Terms & Conditions
These terms overview our "Hosting Services", which include; but are not limited to, the provision of web hosting, domain registration services, and support services. The terms outlined within this document do not govern our Web Design services.
ST Web design reserve the right to terminate all services obtained by clients for any reason deemed applicable by ST Web design.
These terms are subject to change at any time without prior notice, and all users and clients will be subject to any changes with immediate effect. However ST Web design will make every effort to ensure that customers are notified prior to any changes within our policies.
Conditions
ST Web design reserves the right to refuse service and/or access to its servers at any time. The services provided by ST Web design, or its affiliates, must be used for lawful purposes only. Transmission, storage, or presentation of any information, data or material in violation of British and Northern Ireland legislation is prohibited.
By using the services provided by ST Web design, you agree that you are at least eighteen years of age. Anyone under the age of eighteen is not permitted to use any services that ST Web design provides.
Illegal Material
We do not permit any material, or content which is deemed illegal under UK and Northern Irish Legislation. This includes; but is not limited to:
- Material, data or content protected by Copyright protection
- Protected MP3 music files
- Commercial audio and video material
- Illegal pornography (See below)
Pornography
ST Web design does not permit any form of pornography to be hosted, stored or transferred through our network and/or servers. ST Web design retains the right to decide which material is considered as pornography, as we understand that some depicted nudity is solely artistic in nature. However, we must be notified and given time to decide on the nature of any imagery prior to it being uploaded.
Proxy Servers
ST Web design does not allow any proxy set-ups or connections or any sort of activity through remote proxy connections on our servers. First offence will result in suspension, Any account guilty of a second violation would result in immediate account termination.
IRC Hosts
IRC client or server scripts which interacts with our network in any shape or form will render your account for immediate suspension. We also do not permit P2P software, game-hosting software or any software/scripts which could have an impact on the other server users.
Resource Limits
Your hosting account is limited to the resources for which the client has purchased. If you happen to exceed any of the agreed resources, then your hosting account will be suspended. The client will be given the option to purchase additional resources in the event of their account being suspended/terminated. If the client does not wish to purchase additional resources, their account will remain suspended, and may possibly be removed from the network.
Commercial Advertising
Spamming, or the process of sending illegal and/or unsolicited e-mail electronically is strictly forbidden. ST Web design will remain the sole arbiter as to what constitutes as a violation of this provision. We have set a limit of 200 outgoing e-mails per hour on our standard web hosting packages. Clients are unable to send more than the specified number of e-mails within an hour, irrespective of the capacity of their mailing-lists.
Fair Usage Policy
ST Web design reserves the right to suspend and/or terminate any web hosting account which we feel is using too much server resources. This includes, but is not limited to:
- Too many MySQL/PostgreSQL databases
- Too many addon/parked domain names
- Too many sub-domains
- Too much CPU/RAM usage
Violation of our spam policy
A first violation of our spam policy may result in an "Administrative Fee" of 150GBP (£), and the client's account will be reviewed for possible immediate termination. A second violation of our spam policy may result in an "Administrative Fee" of 300GBP (£) and an immediate termination of the client's account. Clients who violate this policy agree that in addition to these "Administrative" penalties, they may be applicable to pay "Research Fees" not to exceed 100GBP (£) per hour that ST Web design employees must spend to investigate the matter.
Backups
ST Web design makes every effort to ensure all data is regularly backed-up. However, ST Web design will not remain responsible for any existence, accuracy, or regularity of its backup services, and therefore leaves the client responsible for making any necessary
Security
Whilst ST Web design attempts to secure its services, the client is responsible for the security of their web hosting account. As a client, you agree to not share your password with anyone. It is your responsibility to ensure your password remains secure, as it provides 24/7 access to your web hosting account.
As a client, it is your sole responsibility to adopt adequate security measures to prevent unauthorised access to your web hosting account.
You are forbidden to access material for which you are not authorised, and to circumvent any security restrictions which have been provisioned.
Support
ST Web design offers support for all of its services. Each client is limited to 1 hour of accumulated support each month. Each support request or incident should consist of no more than 15 minutes. Any incident which takes longer than the 15 minute limit will be charged at an additional rate of 25GBP (£) per hour.
Should the client exceed their monthly limit of 1 hour accumulated support, a charge of 25GBP (£) will also be applicable for each support incident per hour.
This excludes all administrative and/or research fees which may be applicable if a policy has been violated by the client.
Cancellation and Refunds
ST Web design reserves the right to refuse refunds, and/or terminate service on receipt of an abuse complaint(s). Domain registration fees are non-refundable and are not within the purview of our guarantee.
Any hosting package or plan which came with a free domain will not be applicable to a full refund. Domain registration charges will be subtracted from all refunds due to ICANN restrictions.
Clients who pay on a yearly invoice are entitled to a refund within the first 30 days of purchasing their hosting plan/service.
Only first-time accounts are eligible for a refund. For instance, if the client had an account with ST Web design before, cancelled and then signed up again, the client will not be eligible for a refund or if you have opened a second account with ST Web design.
Billing
ST Web design may refuse service to anyone who has failed to pay the agreed charge for the services they have obtained through TWR Web Design.
ST Web design will suspend and/or terminate service to those clients who fail to pay 100% of their invoice 10 days after the due date.
ST Web design reserve the right to charge a 10% late-fee for overdue invoices.
Violation of this policy
Should the client violate any of the details set out within this document, then their hosting account and/or any other services shall be subject for immediate suspension. For smaller violations, the client will be given the opportunity to change or rectify their violation. Larger violations will be dealt with at ST Web design discretion. What is deemed to be a small or large violation is solely defined by ST Web design.
ST Web design reserves the right to refuse service and/or suspend current services at any time for any reason as deemed appropriate by ST Web design. ST Web design reserve the right to charge the client any administrative or research fees due to a violation of this policy made by the client.
